From the New Braunfels Police Department:

A pedestrian attempting to cross I-35 early this morning was struck and killed.

On Dec. 3, 2015, at approximately 12:23am, a New Braunfels Police officer on routine patrol in the 1200 block of I-35 South noticed a male wearing dark-colored clothing acting suspiciously outside of a gas station at the intersection of Walnut and I-35. As the officer approached, the man fled on foot across Walnut Avenue. More officers arrived and they followed him on foot around several businesses located along Walnut Avenue and along the southbound I-35 frontage road.

The male ignored repeated orders from officers to stop as he attempted to jump fences and elude officers who eventually lost sight of him in the area behind the Morris Glass Company and U-Haul along the southbound frontage road. The male was next seen running across the southbound frontage road, across the grass median, and onto the main lanes of southbound I-35 where he was struck by a passing pickup truck traveling in the inside lane of traffic near the concrete center median.

The male did not survive the impact and he was pronounced dead at the scene. Next of kin has been notified and he has since been identified as 15-year old Daniel Garcia of New Braunfels.

The 19-year old male driver of the truck and his 22-year old male passenger, both from Taylor, TX, were transported to Resolute Hospital in New Braunfels as a precaution. At this time, the driver is not facing any criminal charges.

The southbound main lanes of I-35 in that immediate area were closed for approximately 2½ hours following the incident so that investigators could process the scene.
